Bill Pay Samsung 10.1 Tablet and MiFi Bundle Terms and Conditions
1. The following terms and conditions of the Pay-Monthly Samsung 10.1 Tablet and MiFi bundle offer (“the Offer”) are in addition to and form part of the terms and conditions of the Three Service set out in the Smallprint and the Price Guide including the Bill Pay terms and conditions of service, the terms and conditions of the Broadband Active or Broadband Pro (“Broadband Plan”) and terms and conditions relating to the use of Add-ons. In the event of any conflict, these terms and conditions shall prevail.
2. The Offer consists of two devices (i) the Huawei E586 (the “MiFi”) and (ii) the Samsung Samsung Galaxy Tab 10.1 tablet (the “Tablet”) (together, the “Devices”) and are available for a single bundled up-front price (see Three.ie or ask in-store for details) to customers who meet Three’s pay monthly eligibility criteria and who sign up for a 24 month minimum term on direct debit to (i) Broadband Active or Broadband Pro (“Broadband Plan”), and (ii) to Three’s MBB Device Add On plan at €20.33 per month (collectively the “Plan”).
3. Customers will receive one bill for the Plan for both the applicable Broadband Plan and Three’s MBB Device Add On plan.
4. Customers are not permitted to cancel the Plan, or either the applicable Broadband Plan or the Three’s MBB Device Add On plan component within the 24 month minimum term. Customers will be subject to an early termination fee if the Plan is terminated by Three within the 24 month minimum term due customer’s breach of these terms and conditions (including those referred to in the first paragraph), for all elements of the Plan i.e. the applicable monthly minimum recurring fixed charges under the applicable Broadband Plan and €20.33 per month for Three’s MBB Device Add On plan until the end of the 24 month minimum term (“Cancellation Fee”).
5. It is a condition of Three making available the Offer and the Plan that you set up and maintain a direct debit with your financial institution to pay the monthly recurring fixed charges under the Plan. In the event that you cancel your direct debit, or payment of the monthly fixed charges due under the Plan by the direct debit is rejected by your financial institution, then Three may suspend your access to the Three Services.
6. Where your direct debit is cancelled by you or if the direct debit is repeatedly declined by your financial institution, we may terminate your access to Three services under the Plan and you will then be responsible for payment to us of the Cancellation Fee as well as any other outstanding amounts due to us under the Plan.
7. Three’s MBB Device Add On at €20.33 per month includes 150 SMS per month that can be used to message any Republic of Ireland mobile network from the Republic of Ireland or to message any Republic of Ireland mobile network from a Three Like Home mobile network (premium rate services and shortcodes are excluded) and is only available in conjunction with the Offer. Unused SMS in any month cannot be carried forward to subsequent months will not be refunded or credited against any payment due to Three.
8. If you purchase the Plan via Three’s telesales or online sales channels and wish to cancel the purchase by availing of your statutory seven-day cooling-off period, you must return, at your cost, both Devices unused and otherwise in accordance with the terms and conditions of purchase of Three’s telesales or online sales channels.
9. If you meet Three’s eligibility criteria to cancel your Plan under Three’s 14 day money back guarantee policy, you must return , at your cost, both Devices to Three. If you experience any restriction or limitation in your ability to access data services and the internet arising solely as a result of any deficiency in the wi-fi signal received by the Tablet (or other device) and not as result of the standard of coverage of Services provided by Three’s network you may not cancel your contract under Three’s 14 day money back guarantee policy. Customers acknowledge that the standard and speed of service experienced by the Tablet (or any other device served) served by the MiFi will vary due to factors including, without limitation, proximity to the MiFi, number of devices served by the MiFi, and the power supply to the MiFi and that Three has no responsibility for these factors outside of its control. The exclusions in this paragraph do not affect your statutory rights.
10. Data Roaming on Three Like Home Networks at domestic rates is included in the Plan as a promotion until30 April 2012. For details of Three Like Home Networks, see the Price Guide. Three may amend or extend this promotional part of the Plan.
11. This Offer is not available with any other promotion, offer or discount and may not be available with all Three affinity schemes.
12. Three reserves the right to withdraw the Offer either generally or in respect of any particular Customer at anytime and to vary or amend any element of the Offer at any time without further notice. These terms and conditions may be varied or amended by Three for any valid commercial, technical or operational reason.
